Terms & Conditions

Before placing an order, we encourage you to take a moment to review our Terms and Conditions.

General

These terms apply to all sales of furniture and goods by The Everwood Collection (PVT) LTD. We reserve the right to update these terms at any time.

Orders and Production

Custom Nature

All items are custom-made to client specifications. Once production has commenced, orders cannot be changed or cancelled without penalty.

Natural Materials

Wood is a natural material. Variations in grain, colour, texture, knots, and finish are inherent characteristics of the timber and are not considered defects. The final product may differ slightly from photographs or samples due to these natural variations.

Dimensions

For custom pieces, slight tolerances (± 1-2cm) are standard in hand-crafted furniture.

Digital Representation

While we strive to display colors as accurately as possible, we cannot guarantee that the colors displayed on your screen or in digital mockups perfectly reflect the actual product. Fabric and paint colors may vary slightly from physical samples due to dye lot variations and screen settings.

Material Availability

Quotes are based on current material availability. If a selected fabric or material becomes out of stock between the time of quotation and the receipt of the advance payment, we will notify the client immediately to select a suitable alternative. We are not liable for stockouts at third-party suppliers.

Variations

Any changes to the design, dimensions, or finish requested by the client after the order confirmation (Advance Payment) will be subject to a "Variation Order." This may incur additional costs and extend the delivery timeline. We reserve the right to decline changes if production has advanced beyond a certain stage.

Payment Terms

To confirm an order and commence production, payment must be made as follows:

Advance Payment

A 50% non-refundable deposit is required to confirm the order.

Interim Payment

A further 25% payment is due two (2) weeks from the production start date.

Final Payment

The remaining 25% is payable prior to or at the time of delivery/handover. If delivery is deferred at the client’s request or due to client-side circumstances, full settlement of the outstanding balance shall be due upon notification that the items are ready for delivery.

Ownership

Legal title to the goods remains with The Everwood Collection until full payment has been received.

Ready-Made Items

Full payment (100%) is required at the time of purchase unless otherwise agreed in writing.

Late Payments

We reserve the right to pause production immediately if the interim payment is not received by the due date. The final delivery date will be adjusted accordingly.

Delivery and Access

Delivery Area

We provide free delivery within Colombo city limits. Delivery outside this zone will incur a delivery fee, calculated based on distance and volume.

Access Responsibility

It is the sole responsibility of the client to ensure that the furniture ordered can fit through all entryways, elevators, stairwells, and doorways at the delivery location.

Ground Floor/Elevator Access

Standard delivery includes placement to the ground floor or floors accessible via a service elevator. Our delivery team is not authorized or insured to manually hoist furniture up flights of stairs.

Failed Delivery

If furniture does not fit or cannot be delivered due to access restrictions, the item remains the property of the client, and the full balance is still due. Re-delivery attempts or specialized hoisting services (if arranged by a third party) must be at the client's expense.

Storage

If the furniture is ready for delivery but the client is unable to accept it (e.g., site not ready), we can store the items free of charge for seven (7) days. Thereafter, a storage fee of LKR 1,000 per day will apply. All storage fees and the final balance must be cleared before the items are released for delivery.

Timelines

Production and delivery dates provided are estimates only. While we aim to meet these targets, The Everwood Collection (PVT) LTD is not liable for delays caused by external factors, including but not limited to material shortages, shipping delays, weather conditions affecting drying times, or force majeure events.

Assembly & Installation

Standard delivery includes the assembly of free-standing furniture items (e.g., attaching table legs). It does not include wall-mounting, electrical work, or carpentry modifications to the client's premises (e.g., cutting skirting boards) unless explicitly stated in the invoice.

Warranty

We provide an 8-Year Warranty on wooden structures covering manufacturing defects only.

Exclusions

This warranty does not cover fabric, upholstery, foam, or damage resulting from:

Moisture, humidity, or termites

Direct exposure to sunlight (fading/cracking)

Misuse, improper handling, or accidents

Modifications made by client or third parties

Normal wear and tear

Intellectual Property & Marketing

Photography

We reserve the right to photograph the finished furniture before or upon delivery for our quality assurance records and marketing portfolio (social media/website). We will ensure that client privacy is maintained and no personal details or identifying features of the home (other than the immediate setting of the furniture) are disclosed.

Liability

The Everwood Collection (PVT) LTD's liability for any claim shall not exceed the invoice value of the goods. We are not liable for any indirect or consequential losses.

Governing Law

These terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts of Colombo.
